Employer Nomination Scheme (subclass 186)

This visa is a permanent visa for skilled workers sponsored by an approved Australian employer. This visa allows them to work and live in Australia indefinitely. However, Australian employers can only nominate an overseas skilled worker if they cannot find a suitable Australian citizen or permanent resident to do the skilled work and have a genuine need for a paid employee to fill a skilled position. 

This visa includes three streams:

• hold Subclass 457 visa  and have worked for at least two out of the three years in the same occupation with their nominating employer and the employer wants to nominate them for a permanent position in that occupation, and the nomination has been approved
• hold Subclass 482 visa and  have worked for at least three out of the four years in the same occupation with their nominating employer and the employer wants to nominate them for a permanent position in that occupation, and the nomination has been approved.
•  are under 45 years old at the time of application unless they are exempt from this requirement.
• have at least competent English unless they are exempt from this requirement.

2. Direct Entry Stream is for people who:

•  have been nominated by their employer under the Direct Entry stream
•  have never, or only briefly, worked in Australia, or
•  hold subclass 457 or 482 visa but do not qualify for the Temporary Residence Transition stream
• Obtained a suitable skills assessment for their nominated occupation unless they are exempt from this requirement.
• Have at least three years of relevant work experience.
•  are under 45 years old at the time of application unless they are exempt from this requirement.
• have at least competent English unless they are exempt from this requirement.

3.      Labour Agreement Stream is for people who:

• Have been sponsored by an employer through a labour agreement.
• Met the age, skills and English language requirements stated in the agreement.

 Including Family Members:

 You can include the following family members in your application:

1. Your partner
2. Your dependent children/stepchildren or your partner's dependent children/stepchildren

What this visa lets you do in Australia:

 This visa is a permanent visa and allows you and any family member migrating with you to:

1. Stay in Australia indefinitely.
2. Study and work in Australia.
3. Enrol in Medicare.
4. Sponsor eligible relatives for certain temporary or permanent visas.
5. Apply for Australian citizenship when you meet the citizenship requirements.
